Barnes
The London Borough of Richmond have granted planning permission for the redevelopment of an existing car park and part of a former beer garden to create six dwellings and a new car park. The site lies to the west of the former Boileau Arms Public House, at the junction of Castelnau and Lonsdale Road.

Two, 5-bedroom dwellings, three, 3-bedroom dwellings and one, 2-bedroom dwellings will be created. The two 5-bedroom dwellings will be semi-detached villas fronting Lonsdale Road. The other four dwellings will be in a mews and will effectively extend Castelnau Row northwards. Ten car parking spaces will be re-provided for the Public House.

Appeal Decision Upheld In Court
Chesham, Bucks (Chiltern District Council)

In September 2003, a mixed-use (residential/office) permission for redevelopment of a car-repair/sales site was granted on an appeal following an Informal Hearing. The Local Planning Authority lodged a challenge in the High Court, alleging that the Inspector had wrongly applied the guidance on loss of industrial land in PPG3. The challenge was dismissed at a Court hearing in May 2004. CgMs presented the case at the Appeal hearing and prepared a comprehensive witness statement to assist in the defence of the appeal-decision in court.

GENERAL

The Planning and Compulsory Purchase Act
The Planning and Compulsory Purchase Act received Royal Assent on 13th May. The Government intends to bring the provisions of the Act into force over the coming months through a series of commencement orders. It is the convention that no part of an Act should be brought into effect earlier than two months after Royal Assent other than in exceptional circumstances.
The Act contains a number of powers enabling the Secretary of State to make subordinate legislation such as regulations or orders.
The following timetable sets out an indicative timetable for these commencement orders.

Provisions Commencement Date
Regional Planning (Part 1) September 2004 (together with associated regulations and PPS 11).
Local planning (Part 2) September 2004 (together with associated regulations and PPS 12).
Development Plan and Sustainable Development (Part 3) September 2004.
Development Control (Part 4) A number of these provisions are dependent on new regulations or changes to the General Development Procedure Order. Where that is the cases and the draft regulations or GDPO changes have already been subject to consultation, provisions are expected to be brought into effect in September 2004. Where the regulations or GDPO changes have not yet been subject to consultation, that will take place in the Autumn and the provisions are expected to come into effect in early 2005. Regulations on planning obligations will not be made until early 2006.

HISTORIC BUILDINGS

Newell Green Farm, Berkshire
CgMs' Historic Building Team has been successful in rebutting an application for the spot listing of a much-altered seventeenth century building in Berkshire. Following close examination of the structure and a detailed assessment of the architectural and historic interest of the building it was considered that the building did not merit Statutory Listing status. CgMs were involved in producing and submitting a comprehensive rebuttal statement on behalf of the owner of the building and was successful in its refute.

Twickenham Pool
CgMs provided expert witness at a call-in inquiry concerning the demolition of Twickenham Pool, a 1930s Art Deco building within a conservation area next to the River Thames. The Secretary of State granted Conservation Area Consent, on the recommendation of the inspector, and accepted the CgMs case that the building did not make a positive contribution to the character or appearance of the area.

GENERAL

The Department of Culture Media and Sport has announced a number of changes to the way buildings are listed and protected, and these will be phased in by legislation and new procedures during the next three years. There will be a new "Super list" of all historic buildings and sites, and there will be new rights for owners and managers of historic buildings, including a formal appeal against listing. Some 250 buildings are de-listed each year, but this number may rise with the introduction of the appeal system and with clearer criteria on why buildings should be listed."

ARCHAEOLOGY

North Brentford Quarter
The CgMs Archaeology team have recently completed a desk-based assessment and archaeology section of the Environmental Statement for Barratt West London’s recent planning application for the regeneration of the former Glaxo headquarters complex beside the M4 in West London. The proposed development comprises the refurbishment of the Grade II Wallis House and the adjacent International House, the demolition of all other buildings and the development of a mixed use community of nearly 1000 homes, employment, leisure, entertainment, community space and health and education facilities. CgMs were able to demonstrate that the site had the potential for Prehistoric and Roman remains but that such remains would have been badly damaged by the construction of the existing buildings and that no further investigation would be necessary prior to the granting of planning permission. English Heritage has agreed with these conclusions.

A249 Queenborough to Sheerness Improvement, Kent
As part of CgMs’s term contract to provide archaeological advice to the Highways Agency South Eastern office, we have input into the agreement on the scope of, and the contract for, archaeological works required in advance of, and during, the construction of the DBFO scheme for the upgrade of the A249 and new bridge onto the Isle of Sheppey. The archaeological fieldwork is on going and so far has revealed a series of cremations of probable Roman date and elements of a possible settlement. CgMs have also been inputting into various other schemes such as the proposed A2 Cobham to Pepperhill improvement, the A34/M4 Chievely Junction improvement.
